1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between Clube Boss and consumers or businesses via the online shop clubeboss.eu . Any differing terms and conditions of the customer are not recognized unless Clube Boss expressly agrees to their validity in writing.

2. Contractual partners and contact

3. Offer, product presentation and conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. By completing the order process, you submit a binding offer. The contract is concluded when we accept your order by sending an order confirmation via email or by dispatching the goods. Automated order confirmations do not yet constitute acceptance.

Technical and design deviations (e.g. slight color variations due to screen settings) are reserved within reasonable limits.

4. Prices, VAT and shipping costs

All prices are in euros and include VAT. Any shipping costs will be clearly displayed at checkout before you complete your order. Promotional prices and discounts are time-limited and cannot be combined unless otherwise stated.

5. Payment terms

The available payment methods (e.g., Shopify Payments, credit card, PayPal) are displayed at checkout. Payment is due upon conclusion of the contract. In the event of chargebacks or failed payments, we reserve the right to claim any costs incurred.

6. Delivery, delivery times and availability

Deliveries are made within Germany. The standard delivery time is 5–12 business days after shipping confirmation. Please allow 1–2 business days for processing before shipment. Partial deliveries are permitted, provided they are reasonable for you and do not incur any additional shipping costs.

If a product is permanently unavailable, we will refrain from accepting your order; in this case, no contract will be formed. We will inform you of any temporary delivery delays via email.

7. Retention of title

The goods remain our property until full payment is received.

8. Right of withdrawal for consumers

Consumers have a statutory right of withdrawal of 14 days from receipt of the goods. Details, deadlines, exceptions, and the model withdrawal form can be found in our cancellation policy . Supplementary regulations are described in the return and refund policy .

9. Returns

Please notify customer service of any returns in advance and follow the return instructions sent via email. Unless otherwise required by law, customers are responsible for the direct costs of return shipping. Further details can be found in the Return and Refund Policy .

10. Statutory Warranty

The statutory warranty rights apply. In the event of obvious transport damage, please report this to the delivery person if possible and inform us immediately to facilitate any claims against the carrier. Failure to report such damage does not affect your statutory rights.

11. Liability

We are liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. In the case of a slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damages typical for this type of contract. Otherwise, liability is excluded. Mandatory statutory liability provisions remain unaffected.

12. Vouchers, discount promotions and gift cards

Vouchers and discount codes are valid for one-time use only and can only be redeemed within the specified period, unless otherwise stated. Cash payment is not possible. Gift cards can be used for goods offered in the shop; any remaining balance stays on the card.

13. Customer account

Creating a customer account is optional. Login details must be kept confidential. Clube Boss reserves the right to block accounts in cases of misuse.

14. Data protection

Information on the processing of personal data, cookies, analytics tools and marketing services can be found in our privacy policy .

15. Alternative Dispute Resolution, EU Platform

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr . We are neither obligated nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board. Statutory rights remain unaffected.

16. Force Majeure

Events beyond our control (e.g., natural disasters, strikes, government actions, telecommunications network outages, pandemics) may delay the fulfillment of the contract. In such cases, deadlines will be extended appropriately; further legal rights remain unaffected.

17. Applicable Law and Jurisdiction

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, the mandatory consumer protection provisions of the state in which they have their habitual residence apply. If the customer is a merchant, the exclusive place of jurisdiction is the registered office of Clube Boss; however, we are also entitled to bring legal action at the customer's general place of jurisdiction.

18. Changes to the Terms and Conditions

We reserve the right to amend these Terms and Conditions to the extent necessary to rectify subsequent disruptions to the balance of obligations or to adapt to changes in the legal framework. We will inform you of any significant changes in a timely manner. For contracts already concluded, the Terms and Conditions in effect at the time of the contract's conclusion shall apply.
